Conselhos Municipais de Direitos da Criança e do Adolescente: conceitos, fundamentos, atribuições e formação continuada

Abstract

Os Conselhos de Direitos da Criança e do Adolescente são órgãos paritários, com representantes da sociedade civil e governamentais. Têm como principal atribuição a formulação e a gestão das políticas públicas para a proteção da população infanto-juvenil e de suas famílias, nas instâncias municipal, estadual e nacional. O presente estudo teve por objetivo analisar os fundamentos e as atribuições do Conselho Municipal de Direitos da Criança e do Adolescente de Porto Alegre visando promover ações que contribuam para a efetivação de suas finalidades. Para tanto, a metodologia pautou-se em uma pesquisa aplicada, de abordagem qualitativa, delimitada como estudo de caso, que teve como instrumentos de coleta de dados: levantamento bibliográfico, entrevistas e observação participante. Utilizando-se da análise de conteúdo, o material foi agrupado em quatro categorias semânticas: a) percepção acerca da missão e das finalidades da instituição; b) os desafios e as possibilidades de atuação; c) necessidade de ação formativa/lacunas de conhecimento para o exercício da função; d) estrutura da ação formativa. Identificou-se que grande parte das ações do Conselho encontra-se voltada às necessidades das instituições e, especialmente, à arrecadação e repasses financeiros do Funcriança. Problematizou- se este foco em detrimento do próprio planejamento e controle social de políticas públicas na área. Desse diagnóstico resultou o produto educacional: “Ação formativa para conselhos de direitos da criança e do adolescente”, que aborda as bases para o desenvolvimento da ação conselheira e as práticas do Conselho Municipal de Direitos da Criança e do Adolescente. O Produto Educacional foi avaliado pelos conselheiros a partir das categorias: atratividade, envolvimento, compreensão, aceitação e alcance dos objetivos. Identifica-se que o aspecto das bases para a ação dos conselheiros de direitos - constituída por suas atribuições a partir da legislação, conhecimento de políticas públicas, estrutura do Estado, terceiro setor e sistema de conselhos e legislação, planejamento e gestão do Conselho - tiveram ênfase na análise e na proposta de formação apresentada. Conclui-se que o investimento em formação continuada para os Conselhos de Direitos contribuirá no alcance das suas finalidades institucionais.

The Child and Adolescent Rights Councils are equal bodies, with representatives from civil society and government. Their main attribution is the formulation and management of public policies for the protection of children and their families, at municipal, state and national levels. The present study aimed to analyze the foundations and attributions of the Municipal Council for the Rights of Children and Adolescents of Porto Alegre, aiming to promote actions that contribute to the realization of its purposes. Therefore, the methodology was based on an applied research, with a qualitative approach, delimited as a case study, which had as data collection instruments: bibliographic survey, interviews and participant observation. Using content analysis, the material was grouped into four semantic categories a) perception of the institution's mission and purposes; b) the challenges and possibilities of action; c) need for training/knowledge gaps for the exercise of the function; d) structure of the training action. It was identified that a large part of the Council's actions is focused on the needs of institutions and, especially, on the collection and financial transfers of Funcriança. This focus was problematized to the detriment of the planning and social control of public policies in the area. This diagnosis resulted in the educational product: “Training action for councils on the rights of children and adolescents”, which addresses the bases for the development of advisory action and the practices of the Municipal Council for the Rights of Children and Adolescents. The Educational Product was evaluated by the counselors based on the following categories: attractiveness, involvement, understanding, acceptance and achievement of objectives. It is identified that the aspect of the bases for the action of rights counselors - constituted by their attributions from the legislation, knowledge of public policies, the structure of the State, third sector and system of councils and legislation, planning and management of the Council - had an emphasis on the analysis and training proposal presented. It is concluded that the investment in continuing education for the Councils of Rights will contribute to the achievement of their institutional purposes.
